What Is a Trademark Symbol?

A trademark symbol indicates that a word, phrase, logo, or design is claimed as a brand identifier. There are three main symbols, each with a different legal meaning:

™ vs ® vs ℠ — The Key Differences

™ — Trademark (Unregistered)

The ™ symbol means you are claiming a word, logo, or phrase as your trademark. You do not need to file any paperwork or get government approval to use it. Anyone can put ™ next to their brand name. It signals to the world: "I consider this my brand, and I am asserting my common-law rights to it."

Using ™ does not guarantee legal protection — but it establishes that you are making a claim, which can be important in disputes.

® — Registered Trademark

The ® symbol means your trademark has been officially registered with a government trademark office — such as the USPTO in the United States, the EUIPO in the European Union, or the IPO in the United Kingdom. Registration provides much stronger legal protection than an unregistered ™ claim.

Important: Using ® on a mark that has not been registered is illegal in many countries, including the United States. The USPTO can refuse your registration application and you may face fines if you use ® fraudulently.

℠ — Service Mark (Unregistered)

The ℠ symbol is the service-industry equivalent of ™. It is used for marks that identify services rather than physical goods. For example, a consulting firm, a software-as-a-service company, or a restaurant might use ℠ on their service name before registration. In practice, most businesses simply use ™ for everything — the legal distinction between ℠ and ™ is minor, and ™ is more widely recognized.

When to Use Each Symbol

You only need to place the symbol on the first or most prominent use of the mark in a document or page. You do not need to put it after every single mention.
